The inefficiency of the administrative apparatus further highlights the limits and paradoxes of the current legislation. The \u201cEro Straniero\u201d (I Was a Foreigner) campaign instead advocates for a flexible entry system that can ensure social and labor inclusion in our country.<\/em><\/p>\n<p>&nbsp;<\/p>\n<p>In recent years, political parties and the media have often shifted public opinion&#8217;s focus to landings, the reception system, and border defense. This narrative undermines a long-term vision that combines the duty to welcome those in need of protection with the goal of promoting social inclusion processes and ensuring migrants arrive in Italy in a planned and safe manner. This approach calls for a diversified entry system that considers, on the one hand, the needs and stories of migrants and, on the other, Italy&#8217;s demographic crisis, societal transformation, and the requirements of the productive sector.<\/p>\n<p>The legal system, which has been inadequate since the Bossi-Fini law and subsequent partial amendments (see also Sergio Briguglio\u2019s article in this issue), is compounded by the shortcomings of the public administration. Structurally understaffed and dealing with outdated procedures and systems, it fails to effectively address current realities. The result is a legal and bureaucratic framework that structurally produces irregular immigration and, even when it seeks to regularize based on evident labor market priorities, fails to do so effectively.<\/p>\n<h3><strong>An Aging Europe Needs Immigrant Workers<\/strong><\/h3>\n<p>Let\u2019s start with a fundamental fact: Europe has been experiencing a demographic crisis for many years, leading to a progressively aging population. According to Eurostat projections for 2070, over the next fifty years, Italy&#8217;s population is expected to decrease from 59 million to 53 million (-9.6%), and those over 65, currently 24% of the population, would constitute 33.6% of the total. In the long run, this would lead to a numerical parity between workers and retirees, making the current pension system unsustainable. Structural reforms are needed to reverse this trend, and migration policies must be reconsidered as part of the solution.<\/p>\n<p>The Moressa Foundation&#8217;s Immigration Economy Report reveals that even today, the immigrant population mitigates the demographic decline, positively affecting the economy, taxation, and welfare sustainability. In 2023, foreign workers made up 10% of total employment in Italy, contributing \u20ac164 billion to GDP\u20148.8% of the national GDP. Confindustria also suggests increasing the intake of foreign workers; its latest labor survey shows that 69.8% of Italian companies seeking personnel in the first half of 2024 faced recruitment difficulties.<\/p>\n<p>Yet, entering Italy for work purposes remains an uphill journey.<\/p>\n<h3><strong>A Tortuous Procedure<\/strong><\/h3>\n<p>In Italy, work-related entry is governed by annual flow decrees, which set quotas for foreign workers based on their country of origin and employment sector. The process begins with the publication of the \u201cflow decree,\u201d which specifies the dates for submitting employment applications (the so-called &#8220;click day&#8221;). Within these quotas, an employer in Italy commits to hiring a resident of a third country\u2014presumably without ever having met them. Paradoxically, they cannot regularize or hire a foreign worker already in Italy, who may have received training but failed to renew their residence permit.<\/p>\n<p>Some adjustments to the flow decree have been introduced to address labor market demands, but the situation has not changed significantly. According to the latest report by the \u201cEro Straniero\u201d campaign, in 2023, companies submitted over 462,000 job applications\u2014more than six times the government&#8217;s set quotas.<\/p>\n<p>Another alarming fact revealed by the campaign is the low ratio between the established quotas and actual contracts signed: in 2023, only 23.5% of the quotas translated into residence permits. Less than one in four individuals provided for in the flow decree managed to stabilize their position by securing work and documentation. It includes a buffer measure allowing individuals to remain in Italy for sixty days after the end of a seasonal work contract to find new employment. However, the decree complicates the procedure further, making it more bureaucratically cumbersome and time-consuming. For example, only those who pre-registered their applications three months in advance during a short and poorly advertised window could participate in the February 2025 click day. By December, shortly after the pre-registration phase closed, the Interior Minister, Matteo Piantedosi, reported 180,012 pre-registered applications for 180,720 available quotas. This time, the requests were fewer than the available slots. The minister attributed this reversal to stricter controls introduced in the new decree to verify the authenticity of applications and prevent fraud. However, testimonies from support organizations and individuals suggest that the decrease in applications may be due to the lack of notice and increased bureaucratic burdens. If true, the risks are twofold: a continued failure to meet the needs of the productive sector and further growth in undocumented and precarious work.<\/p>\n<p>The current &#8220;on-call&#8221; entry system has shown its weaknesses and continues to do so. Alternatives are needed, such as extraordinary measures. For example, in 2020, the Conte II government launched a program to formalize irregular or potential labor relations. It allowed undocumented workers already in Italy to regularize their status in limited sectors, such as agriculture and domestic work. About 207,000 individuals participated. Four years later, tens of thousands of foreign workers are still awaiting a response: according to \u201cEro Straniero,\u201d one in four applications has not yet been processed (figure below). Two public class-action lawsuits were filed against the prefectures of Rome and Milan.<\/p>\n<p>The lawsuit against Milan\u2019s prefecture resulted in a landmark ruling from the Council of State, affirming that even in immigration law, the maximum time for any administrative procedure is 180 days. With sufficient financial resources, as in the case of the amnesty, the public administration cannot justify delays based on the high volume of applications or fraud attempts.<\/p>\n<p>After seven amnesties, thousands of testimonies, and collective actions by numerous organizations, it is clear that extraordinary regularization is an inadequate emergency solution to a structural problem.<\/p>\n<p>A comprehensive reform is needed to go beyond the measures introduced in recent years and design a flexible system that facilitates regular entry of foreign labor and ensures social and labor inclusion. To address the undocumented population in Italy, the \u201cEro Straniero\u201d campaign has long proposed a mechanism for regularization accessible on an individual basis when an employer is willing to hire or the individual is deeply rooted in the community. This system should respect foreign workers&#8217; rights while addressing the needs of the productive sector and families. They also call for diverse entry pathways, such as employer sponsorships, intermediaries, or direct visa applications by workers with financial guarantees. It is crucial to open a dialogue on these already formalized proposals, adopting a long-term, non-ideological perspective on immigration.<\/p>\n<p>&nbsp;<\/p>\n<p><em>Sara Albiani is a policy advisor at Oxfam Italia.
